    1. About this manual

    This manual is published in terms of section 51 of the Promotion of Access to Information Act 2 of 2000 (“PAIA”). It tells you what records Todae holds and how you can ask for access to them. PAIA gives you a right of access to records held by a private body where the record is required to exercise or protect any right.

    3. The Information Regulator

    The Information Regulator oversees both PAIA and POPIA and has published a guide on how to use PAIA. You may contact the Regulator at:

    4. Categories of records we hold

    The main categories of records we keep include:

    • Customer & order records — accounts, quotes, orders, delivery details, invoices and correspondence.
    • Returns & warranty records — claims, assessments and resolutions.
    • Financial & tax records — accounting records, VAT and tax filings, and bank records.
    • Supplier & product records — supplier agreements, price lists and product data.
    • Company & statutory records — registration documents and records required by the Companies Act.
    • Employment & contractor records — where applicable.
    • Information covered by other laws — records kept under the VAT Act, Companies Act, Consumer Protection Act, ECTA and POPIA.

    Some records are confidential, subject to third-party rights, or protected from disclosure under PAIA.

    5. How to request access to a record

    1. Complete the prescribed PAIA request form (Form 2, available from the Information Regulator's website).
    2. Send the completed form to our Information Officer at info@todae.net.
    3. Provide enough detail to identify the record and the right you seek to exercise or protect, and how you would like to receive it.
    4. Give proof of identity, and of authority if you are acting for someone else.

    We will respond within 30 days, as PAIA allows. This period may be extended in the limited circumstances the Act permits, in which case we will tell you.

    6. Fees

    PAIA allows a request fee and an access fee (for the time and materials to find, prepare and provide the record), calculated in line with the fees prescribed under the Act. We will give you an estimate before we proceed where a fee applies, and you may be asked to pay a deposit.

    7. Grounds on which we may refuse

    We may refuse access on any ground set out in Chapter 4 of Part 3 of PAIA — for example, to protect another person's privacy, commercially sensitive or confidential information, or legally privileged records. If we refuse, we will give reasons and explain your right to challenge the decision, ultimately through the courts.

    8. Requests for your own personal information (POPIA)

    If you simply want access to, or correction of, your own personal information, you can also use your rights under POPIA — see our Privacy Policy. Either way, contact our Information Officer and we will help you use the right process.
